    Common Credit Reporting Problems

If any of these happened to you, the credit bureau or the company reporting the information may have broken the law.

    Accounts That Aren't Yours

Debts, inquiries or collections that belong to someone else, often from identity theft or a mixed credit file.

    Ignored or "Verified" Disputes

You disputed an error and the bureau marked it verified without a real investigation, or never answered.

    Wrong Balances or Late Payments

Paid-off accounts still showing a balance, or late payments reported when you paid on time.

Old Debts That Should Be Gone

Most negative items must come off after 7 years. Old accounts re-aged or still reporting may break that rule.

    Duplicate Collections

The same debt listed twice, by the original creditor and a collector, both showing a balance owed.

    Errors That Cost You Credit

A loan, card, apartment or job you were denied or charged more for because of wrong information.

What Can You Recover Under the FCRA?

The Fair Credit Reporting Act lets consumers sue credit bureaus and the companies that furnish information when they fail to follow the law (15 U.S.C. §§ 1681n and 1681o).

Correction or removal of the error
Actual damages, such as a denied loan or higher rate
Statutory damages of $100 to $1,000 for willful violations
    Punitive damages for willful violations
Attorney's fees and costs if you win
